Last night, President Trump nominated D.C. Court of Appeals Judge Brett Kavanaugh to fill retiring Justice Anthony Kennedy's vacancy on the Supreme Court.
Judge Kavanaugh has been presented to the American people with impeccable academic credentials and expansive professional experience. Most recently, he served for 12 years on the bench of the U.S. Court of Appeals for the D.C. Circuit. He has written over 300 judicial opinions and the Supreme Court has endorsed his opinions more than a dozen times. His 100 most-cited opinions have been used by more than 210 judges. As President Trump noted, Kavanaugh, "is a judge's judge."
+ + In his own words...
In his nomination acceptance speech last night, Judge Kavanaugh said that his judicial philosophy is, "[S]traightforward. A judge must be independent and must interpret the law, not make it." Kavanaugh also stressed he believes in interpreting statutes and the Constitution as they are written, "informed by history and tradition and precedent."
Judge Kavanaugh is committed to interpreting the text and original meaning of the Constitution and statutes. Judges must be bound to the text and original meaning of the law. This simple judicial constraint will prevent the Supreme Court and any other court from bending the law to support personal ideologies. The Supreme Court needs to remove itself from political decision-making and personal preferences.
These are among the reasons why Liberty Counsel has launched a petition campaign to tell Senators to confirm Judge Kavanaugh as the next Supreme Court Justice. Click here to add your name to our "Confirm Judge Brett M. Kavanaugh" petition.
+ + The Left's over-the-top opposition
The Left will not allow Judge Kavanaugh to be confirmed without an intense battle. Rancorous protests have already sprung up across the nation.
As reported by CNSNews, in two separate television interviews this morning, Senate Minority Leader Chuck Schumer (D-NY) said "he believes Judge Kavanaugh is 'far, far right on so many issues,' including presidential power, gun rights, environmental rights, and LGBTQ rights. 'He is not a mainstream judge.' Schumer also said, 'I will oppose him with everything I've got.'"
So far, the two loudest complaints against Kavanaugh from the Left are his alleged threats to so-called "women's rights," code for "abortion rights," and the repeal of ObamaCare. Other Leftist talking points include the notion that President Trump should not be appointing a Justice while he is under federal investigation for Russian collusion and obstruction of justice.
+ + The next hurdle is the Senate Judiciary Committee
Judge Kavanaugh will be meeting with Senators individually before his formal confirmation process begins with hearings before the Senate Judiciary Committee. We expect an extremely intense hearing process!
Committee Chairman, Chuck Grassley (R-IA) said, "Judge Kavanaugh is one of the most qualified Supreme Court nominees to come before the Senate. His credentials are well known, and he's served with distinction as a judge on the esteemed D.C. Circuit for more than a decade. He is a superb mainstream candidate worthy of the Senate's consideration."
Committee Ranking Member Dianne Feinstein (D-CA) said of Kavanaugh in a statement, "His views are far outside the legal mainstream when it comes to access to health care, executive power, gun safety, worker protections, women's reproductive freedom, and the government's ability to ensure clean air and water, to name a few." Feinstein opposed Kavanaugh's appointment to the D.C. Circuit Court in 2006.
+ + "The best of the best"
The White House said in a statement that, "Judge Kavanaugh is the best of the best, who builds consensus and decides cases based on the law, not personal policy preferences."
Speaking as a constitutional attorney, I believe that Judge Kavanaugh is a tremendous choice. He is the right kind of judge and we need him on the Supreme Court bench.
Thank you and God bless you,
P.S. The Confirm Kavanaugh petition campaign is the first of several steps Liberty Counsel will take to help Judge Kavanaugh win his seat on the U.S. Supreme Court. We will not back down from the battle ahead.
